How the Idaho Juvenile Justice System Works
The Idaho juvenile justice system handles cases involving individuals under the age of 18 who are alleged to have committed a delinquent act. The system differs from adult criminal court in important ways — the emphasis is on rehabilitation rather than punishment, and the records generated are generally sealed and confidential.
Delinquency proceedings are initiated when a complaint is filed alleging a juvenile committed an act that would be a crime if committed by an adult. The proceedings are civil in nature, but the consequences — including detention, probation, treatment requirements, and in serious cases, commitment to a youth correctional facility — are very real.
Diversion programs allow many first-time or lower-level juvenile offenders to address their cases outside of formal court proceedings, through community service, counseling, restitution, and other requirements. Successfully completing diversion typically results in no formal adjudication on the juvenile’s record.
Informal adjustments allow law enforcement or probation officers to resolve minor matters informally without filing formal charges.
Formal adjudication occurs when the case proceeds to a hearing where the court determines whether the juvenile committed the alleged act. Unlike adult criminal court, there is no jury — a juvenile court judge decides the case.
When Adult Prosecution Becomes a Risk
In certain cases involving serious charges, Idaho law allows — or requires — that a juvenile be prosecuted as an adult. This is one of the most critical junctures in any juvenile case.
Bindover hearings occur when the prosecution seeks to transfer a case from juvenile court to adult district court. The court evaluates factors including the nature and seriousness of the alleged offense, the juvenile’s prior record, and whether the juvenile is amenable to rehabilitation through the juvenile system. Opposing bindover is often the single most important fight in a serious juvenile case.
Automatic transfers apply in Idaho for certain serious felony offenses when the juvenile is of a specified age. These cases bypass the juvenile system entirely and are prosecuted directly in adult court.
When a juvenile is tried as an adult and convicted, the consequences are the same as for any adult criminal conviction — including a permanent adult criminal record, potential prison sentence, and all associated
collateral consequences.

Diversion and informal resolution. For many first-time or lower-level offenders, the priority is securing diversion or an informal resolution that keeps the case out of the formal court system. A successfully completed diversion program results in no formal adjudication — protecting the juvenile’s record.
Challenging the evidence. The same constitutional protections that apply in adult court apply in juvenile proceedings. Evidence obtained through unlawful searches can be suppressed. Statements obtained without proper advisements can be challenged. We apply the same rigor to the evidence in juvenile cases that we bring to adult cases.
Opposing bindover. When the prosecution seeks to transfer a serious case to adult court, we fight hard to keep the case in the juvenile system. The difference in consequences between juvenile adjudication and adult conviction can be enormous.
Rehabilitative advocacy. The juvenile system’s focus on rehabilitation means that demonstrating a young person’s engagement with counseling, school, community, and family can meaningfully affect how the court approaches the case and what consequences are imposed.
Record sealing. In many juvenile cases, records can ultimately be sealed from public access. We counsel clients and families on the conditions under which sealing is available and plan accordingly.
