Another great example of how I fight for my clients is the client I got fully cleared and acquitted of sexual assault and domestic violence charges. That client has been able to keep custody of his son and resume a military career despite the charges and attempts at administrative punishment.

John’s Background

John Malek is a combat veteran who has over a decade’s experience working as an active duty JAG officer and over 15 years experience navigating the military environment. He dedicated over half of his JAG career working as the Chief of Military Justice, gaining an expertise in the UCMJ and its implementation. John believes that doing what is right for the member should be the driving factor behind the implementation of justice. He has worked diligently from both sides of the justice system to ensure those facing administrative and legal actions receive fair and ethical treatment, ensuring their rights are protected at all times. During his tenure in active duty, John was the leading attorney for over 100 Court-Martials, handling cases involving murder, sexual assault, and other violent crimes. This experience allowed him to critically view the UCMJ and the correct application of charges. He has successfully protected his clients from false accusations of sexual harassment, including full withdrawal of investigation, charges, and formal apology of the initiating command. John has also achieved retention for Airmen being reviewed for administrative separation for fraudulent enlistment while also safe guarding their career from further inquiry on the conduct. He has secured Honorable service characterizations in discharges, which allow members to retain full VA benefits, and has even secured voluntary separations for members during pending sexual assault allegations. Throughout his active duty career, John was heavily involved in advising leadership on the correct and fair application of the military justice system. John entered onto active duty as an Intercontinental Ballistic Missile (ICBM) missile officer, protecting the nation against all threats, he now works solely to protect your career and reputation against all threats.

Maj Malek’s Military Career

Maj John Malek started his military career as an ICBM Crew Commander. His first duty station, Malmstrom AFB, Montana, gave him the opportunity to fine tune his leadership skills and improve upon his ability to effectively handle high stress situations where the decisions he made were critical to national defense. Due to John’s strong leadership skills and expertise, he was chosen to be instructor and led ICBM training and course development for over 200 ICBM officers. He took on an essential role in creating more than 4,000 pages of highly technical training material to ensure global nuclear capability. John was next chosen to become a flight commander at Maxwell AFB, Alabama, where he continued to teach leadership courses.

John was accepted into the ROTC program which allowed him to remain on active duty while he pursued his law degree. While attending law school, John was assigned to Fairchild AFB, Washington as a legal intern, where he developed his legal skills as a JAG Officer and oversaw the nonjudicial punishment (NJP a.k.a. Article 15) program. John was essential in providing guidance to commanders and ensuring the legal and ethical standards of the program. After successfully completing his law degree, was assigned to, F.E. Warren AFB, Wyoming. Here, he litigated multiple hi-visibility and controversial cases involving sexual assault, domestic violence, firearms charges, and other serious crimes. John was appointed as Special Assistant U.S. Attorney for the District of Wyoming, which allowed him to add federal and local experience to his skill set. During his time at F. E. Warren AFB, John was deployed in support of Special Operations Command Africa, Staff Judge Advocate’s Office, to advise after the Niger Ambush. After repeated praise from Joint Service Directorate Chiefs and the commanding General, he was forward deployed to Somalia, as the Command Judge Advocate, where he would advise the Navy SEAL Commander for all of East Africa. After proving himself as a selfless leader and fearless litigator, John was assigned to the busiest legal office in the Air Force. While at Lackland AFB, John led the 23 airmen and civilians of the military justice division. John went on to another busy military justice section at Headquarters Eighth Air Force, where he distinguished himself so well that he was made the Acting Deputy Staff Judge Advocate, leading six legal offices across five states.

Major John Malek currently serves as part of the Oregon Air National Guard, as the Deputy Staff Judge Advocate and a National Guard Bureau Defense Counsel, defending Airmen across the globe.
